When Waters ran Miller's name through the National Crime Information Center database, a hit came back showing Miller had an outstanding felony warrant.Waters called out to Miller by his first name, asking him to come over to the car. Instead, Miller took off running with Waters in pursuit on foot.Miller stumbled and fell and a gun fell from his waistband, according to the complaint. Waters and Santiago arrested Miller on the scene. When backup arrived, Seattle officer R. Bell found a plastic bag in Miller's hooded sweat shirt that contained 19 grams of crack cocaine, the complaint says.The H&K .40-caliber semiautomatic pistol that allegedly fell from Miller's waistband had been reported stolen.Investigators consider Miller to be "a suspect in at least two unsolved shooting incidents," according to the complaint.When Assistant U.S. Attorney Vince Lombardi Jr. recently learned that Miller was being held in the King County Jail since the October arrest, he decided to take the case to federal court, where the penalties are harsher than those meted out in state courts."Gang cases involving firearms are a priority," Lombardi said.If convicted, Miller faces a mandatory minimum five years in prison and up to 40 years for possession of crack with intent to sell it. He could be fined as much as $2 million. He also faces a maximum of 10 years for being a felon in possession of a weapon.Miller also was charged with carrying a firearm in relation to a drug crime, which would bring a mandatory minimum sentence of five years to run consecutively with any other sentence handed down.
